I Have Been Issued A Traffic Citation. Now What?

After a traffic violation conviction, the court will notify the Virginia Department of Motor Vehicles (DMV). You will then receive demerit points that can affect your cost of insurance and can lead to the loss of your license.

How Does The Virginia Demerit Points System Work?

Demerit points are assigned to your license in six-, four- or three-point increments.

Six-point violations include:

  • Speeding more than 80 miles per hour
  • Driving 20 MPH over speed limit
  • Driving too fast for conditions
  • Passing an emergency vehicle or school bus

Four-point violations include:

  • Speeding 10-19 MPH above the posted limit
  • Failing to stop before entering a highway
  • Passing when unsafe
  • Failure to yield

Three-point violations include:

  • Speeding 1-9 MPH above posted limit
  • Driving too slowly
  • Driving without lights on
  • Improper turn/U-turn

Getting 12 points in 12 months or 24 points in 18 months will lead to probation of license. These offenses can add up and cost you your license and your freedom.
