Your License Could Be Affected After A Ticket

In Virginia, the Department of Motor Vehicles (DMV) assesses demerit points for traffic convictions that can affect your insurance premiums and jeopardize the status of your driver’s license. After a traffic case concludes in court, the results are transmitted to the DMV, which subsequently assigns demerit points depending on the severity of the charge.

The length of time the demerits remain on your driving record varies. Some violations may be permanent while others such as speeding linger for several years. Virginia judges have no authority to change the number of demerit points for a traffic violation or speeding ticket as these points are assessed administratively by the DMV.

Minor traffic violations typically only carry a fine and court costs. This may not feel severe at face value, but it is often the collateral consequences from the points applied by the DMV that are of greater concern. This can lead to higher insurance premiums and more severe repercussions for future violations.

The consequences for more serious traffic violations such as reckless driving or driving while intoxicated naturally carry harsher penalties. Consequences may include a significant fine, probation, license suspension or jail time.
