What is child custody based on?

Any parent facing child custody concerns may have many different questions on their minds to which they need answers. It can help for parents to know what to expect from the child custody process and how child custody decisions are made.

Child custody decisions are based on what is in the best interests of the child. There are a variety of factors that are used to determine what is in the best interests of the child. Factors that may be evaluated can include the wishes of the child in some circumstances; the age and sex of the child; any special needs of the child and the ability of each of the parents to meet those needs; the mental and physical health of the parents; religious and cultural considerations; adjustment to school and community; and the need for a continuous and stable home environment.

In addition, other factors that may be considered include to help arrive at a child custody arrangement that is in the best interests of the child including any other children relevant to the child's custody arrangement; the child's relationships and interactions with other members of the household; the opportunity for the child to enjoy support from, and interaction with, extended family members of either of their parents; and if there is any pattern or history of abuse.

Child custody is important for children, families and parents which is why the family law court focuses on what is in the best interests of the child when developing a child custody arrangement. Parents should also focus on what is in the best interests of the child and know how child custody and visitation plans are reached between the parents or with the help of the family law court.
